1. Scope of Agreement
These Terms and Conditions ("Agreement") govern all sales and use of GPOD GOLF products ("Products") and form a binding agreement between the purchaser ("Customer") and GPOD GOLF ("Company"). By placing an order, Customer agrees to be bound by these Terms and Conditions.
2. Payment Terms for Bulk Orders
For bulk orders, defined as orders consisting of 100 or more units:
Deposit: A non-refundable deposit of 50% of the total invoice amount is due at the time the order is placed.
Balance Payment: The remaining 50% is due upon delivery of the Products.
Failure to remit payments on time may result in delays, cancellation of the order, or additional fees.
3. Delivery and Shipping
The Company will make commercially reasonable efforts to deliver the Products within the agreed timeline. However, delivery dates are estimates and may be subject to change due to unforeseen circumstances. The Company shall not be liable for any delays in delivery caused by third-party carriers, weather conditions, or other events beyond its control.
4. Returns and Restocking
All returns are subject to inspection and approval by the Company. Customers are responsible for return shipping labels and costs. Returned items may be subject to a restocking fee, the percentage of which will depend on the condition of the returned items.
5. Product Use and Liability
The Customer acknowledges that the Products are to be used at their own risk. GPod Golf shall not be held liable for any personal injuries, property damage, or other losses arising from accidents or misuse of the Products. By purchasing and using the Products, the Customer assumes full responsibility for ensuring their safe use.
6. Intellectual Property
All designs, trademarks, logos, and intellectual property associated with GPod Golf Products remain the exclusive property of the Company. Unauthorized use, reproduction, or distribution is prohibited.
7. Limitation of Liability
To the maximum extent permitted by law, the Company's liability for damages arising out of or related to the purchase or use of its Products shall not exceed the purchase price of the Products. Under no circumstances shall the Company be liable for any incidental, consequential, or punitive damages.
8. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, USA. Any disputes arising from or relating to this Agreement shall be resolved exclusively in the courts located in the State of Florida.
9. Modification of Terms
The Company reserves the right to update or modify these Terms and Conditions at any time without prior notice. Customers are encouraged to review these Terms periodically for updates.
10. Entire Agreement
These Terms and Conditions, together with any written agreements or invoices, constitute the entire agreement between the Company and the Customer and supersede all prior agreements, understandings, and representations.
